Terms and Conditions of Sullivans Greengrocers

Welcome to the Sullivans Greengrocers website. These Terms and Conditions govern your use of our website and the purchase of products from us. By accessing our website or placing an order, you agree to be bound by these Terms and Conditions.

Throughout these Terms, "we", "our" and "us" refer to Sullivans Greengrocers.

2. Products

We sell fresh fruit, vegetables, grocery items and related food products for local delivery.

As many of our products are fresh and seasonal, their appearance, size, colour and weight may naturally vary. Images shown on our website are for illustrative purposes only and may not exactly represent the products supplied.

Product availability is subject to seasonal supply. Where an item is unavailable, we may substitute it with a similar product of equal or greater value unless you have requested that no substitutions are made. If a suitable substitute is unavailable, we will refund the unavailable item.

3. Placing an Order

By placing an order, you confirm that:

you are legally able to enter into a binding contract;
the information you provide is accurate and complete;
you are authorised to use the payment method provided.

Orders are subject to acceptance and availability. An order confirmation email confirms that we have received your order but does not necessarily mean that it has been accepted.

We reserve the right to refuse or cancel any order where necessary, including where products are unavailable, an obvious pricing error has occurred or fraudulent activity is suspected.

4. Prices and Payment

All prices are shown in pounds sterling (£) and include VAT where applicable.

A minimum order value of £10 applies.

A delivery charge of £2 will be added unless otherwise stated.

Payment is processed securely through trusted payment providers including Stripe, PayPal and major debit and credit cards. We do not store your full payment card details.

Orders will only be prepared once payment has been successfully authorised.

5. Delivery

We currently deliver within selected areas of Cardiff and the surrounding area.

Orders placed before 11:59 pm (midnight) will normally be delivered on the next available delivery day.

Deliveries are made Monday to Saturday, excluding certain Bank Holidays, the Christmas and New Year period, or other advertised business closures.

Delivery times are estimates only and may occasionally be affected by weather, traffic, supplier delays or other circumstances outside our reasonable control.

If nobody is available to accept delivery, your order may be left in a safe place at the delivery address unless alternative instructions have been provided.

6. Fresh Produce and Substitutions

Fresh produce naturally varies in size, colour, weight and appearance.

Where an item is unavailable, we may substitute it with a similar product of equal or greater value to ensure your order can still be fulfilled unless you have requested that no substitutions are made.

If no suitable substitute is available, the unavailable item will be refunded.

7. Subscriptions

Customers may choose to purchase products on a recurring subscription basis.

Subscriptions automatically renew at the frequency selected during checkout until cancelled.

Customers may pause, skip, amend or cancel their subscription at any time before the next scheduled payment is taken through their online account or by contacting us.

Subscription payments are collected automatically using the payment method stored on your account.

If a subscription payment cannot be successfully processed, we may retry the payment, suspend the subscription or cancel that delivery. If payment is not successfully received, the relevant delivery will not be fulfilled.

We reserve the right to amend or discontinue our subscription service where necessary. If we make any material changes, we will notify affected customers where reasonably possible.

8. Cancellations and Refunds

Because many of our products are perishable food items, you do not have the statutory right to cancel your order after delivery under the Consumer Contracts Regulations 2013.

This does not affect your statutory rights under the Consumer Rights Act 2015.

If your order is damaged, faulty, incomplete or not as described, please contact us within 24 hours of delivery. We may request photographs to help us investigate the issue.

Where appropriate, we will offer a replacement, refund or other suitable resolution.

Refunds will normally be processed using the original payment method.

9. Allergies and Food Information

While we take reasonable care when handling food products, items may be packed or stored in environments where allergens are present.

If you have any allergies or dietary requirements and require further information, please contact us before placing your order.

10. Customer Accounts

Customers may create an account to make future purchases easier, manage subscriptions and view previous orders.

You are responsible for keeping your login details confidential and for all activity carried out using your account.

If you believe your account has been accessed without your permission, please contact us immediately.

11. Discount Codes, Gift Cards and Promotions

From time to time we may offer promotional discounts, gift cards or referral programmes.

Unless otherwise stated:

only one promotional offer may be used per order;
discount codes cannot be exchanged for cash;
promotions may be withdrawn or amended without notice;
promotional offers remain subject to product availability.

Additional terms may apply to specific promotions.

12. Website Use

You agree not to misuse our website or knowingly introduce viruses, malicious software or other harmful material.

You must not attempt to gain unauthorised access to our systems or interfere with the operation or security of the website.

13. Intellectual Property

All content on this website, including text, photographs, graphics, logos, branding and website design, belongs to SULLIVANS CATERING BESSEMER MARKET LTD or its licensors.

You may not reproduce, copy, distribute or use any content from this website without our prior written permission.

14. Limitation of Liability

Nothing in these Terms excludes or limits our liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, fraud or your statutory rights under consumer protection legislation.

Subject to the above, our liability shall be limited to the purchase price of the products concerned.

We are not responsible for losses arising from events beyond our reasonable control.

15. Changes to These Terms

We may update these Terms and Conditions from time to time.

The latest version will always be available on our website and will take effect from the published effective date.

16. Governing Law

These Terms and Conditions are governed by the laws of England and Wales.

Any disputes arising in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
